HFA / AFC Rule Change Update

The changes to the HFA and AFC rules initiated in 2022 continue to move through the administrative rule process in 2023.

HFA: The HFA rules were referred by the Department of Licensing and Regulatory Affairs (LARA) to the Joint Committee on Administrative Rules (JCAR) – a legislative committee established to review administrative rules proposed by the department. The timeline requires 15 legislative days to allow for JCAR to review and approve the changes. The timeline started on January 13, 2023. As long as there is no objection from JCAR, the changes could take effect as soon as the end of February.

AFC: The AFC rule changes were submitted for a Public Hearing to receive comments on proposed changes to the AFC rule set. The Public Hearing will take place February 23 at 10 a.m. Changes in AFC rules are not likely to be completed until summer 2023 at the earliest.
