Reminder: ROP Changes Effective October 24 (SNF)

The effective date of the Centers for Medicare & Medicaid Services (CMS) Requirements of Participation (ROP) changes is next week, October 24, 2022. These changes were issued through QSO-22-19-NH, which outlines revisions to the following:

  • Surveyor Guidance for some Phase 2 & and all Phase 3 Requirements of Participation;
  • Arbitration Agreement Requirements;
  • Investigating Complaints & Facility Reported Incidents; and
  • Psychosocial Outcome Severity Guide.

CMS also issued an advance copy of the State Operations Manual to clarify specific regulatory requirements and provide information on how compliance will be assessed. Surveyors will begin using this guidance to identify noncompliance beginning October 24, 2022. In discussions with the Bureau of Survey & Certification (BSC), the association confirmed that surveyors will complete their education related to how to interpret and apply the changes this week. Providers have the opportunity to review the education provided to surveyors by logging into the Quality, Safety, and Education Portal (QSEP). The applicable education is titled, “Long Term Care Regulatory and Interpretive Guidance and Psychosocial Severity Guide Updates – June 2022”.
