HFA / AFC Rule Change Update
The approval process for the change in reporting of incidents and accidents (and other changes) for HFA has hit another snag, as we thought it might. The timeline requires 15 legislative days to allow for JCAR to review and approve the change in rules. However, the required 15 days was not accomplished in this legislative term. Therefore, the rules will be withdrawn from JCAR and resubmitted in the next year in the new legislative session. The rule process overall does not need to restart. Only the legislative review by JCAR needs to be resubmitted. We are cautiously optimistic that the new rules will become effective in early 2023.
The AFC rule changes have not been submitted at the first steps of rulemaking but are undergoing review by stakeholders such as the AFC Advisory Council and Industry representatives such as our association. Changes in AFC rules are not likely to be completed until at least middle of 2023.
